TERMS OF SALE

THESE TERMS OF SALE ARE AN AGREEMENT("AGREEMENT") BETWEEN YOU AND THE GUILTY OBSESSIONS COMPANY. (collectively "GUILTY OBSESSIONS", "we", or "us") TO PURCHASE THE ITEMS IN YOUR ORDER, PLEASE READ THIS AGREEMENT CAREFULLY.  BY SUBMITTING YOUR ORDER (1) YOU AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, (2) YOU ARE CONSENTING TO ENTER INTO THIS AGREEMENT IN ELECTRONIC FORM, AND (3) YOUR CLICK SHALL CONSTITUTE YOUR ELECTRONIC SIGNATURE ACCEPTING THIS AGREEMENT. If you do not wish to accept this agreement, you should not order any products through our website.

ORDERS AND ACCEPTANCE

By submitting an order, you represent and warrant that all personal information you have entered for the order is valid.

Except with respect to out-of-stock items, you cannot cancel or change an order once it has been submitted.  All orders are expressly conditioned upon acceptance by us.  You should notify us immediately if discrepancies are noted in the acknowledgement.  

LACK OF ABILITY

Guilty Obsessions makes a reasonable effort to provide correct inventory information on its website.  If an item, you have ordered becomes unavailable after the order has been placed, we will cancel the order and notify you by phone, mail or e-mail, we reserve the right to cancel orders for out-of-stock items at any time.

PRODUCT DESCRIPTIONS

We attempt to be as accurate as possible in describing our products. The artist may at any time change color and or design without notification or prior notification to consumers, so long as the fragrance is the exact fragrance that is ordered by the customer.

PRICING

All prices on our website are listed in U.S. Dollars.  Prices do not include shipping or handling, which shall be charged on all orders as applicable and will be indicated at the time of your order.

In the event a product is listed at an incorrect price due to typographical or other error in pricing, we have the right to refuse or cancel orders placed for the products listed at the incorrect price whether or not the order has been confirmed or accepted and your credit card charged.  If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price.

QUANTITY LIMITS and PROHIBITION on RESALE

The products purchased on our website are for use by end users only, and you agree not to resell the products to any third party.  We reserve the right to limit the quantities of products available for purchase through our website, or to limit the value of orders placed through our website to $500.  These limits may be applied per order, per person or household, or to orders sharing the same credit card, billing and/ or shipping address, or other account attributes.  

Additionally, we reserve the right, at our sole discretion to restrict sales to customers we otherwise believe are engaged of the resale of our products.  For our purposes, "reselling" involves purchasing or intending to purchase any product from us for the purpose of engaging in a commercial sale of the same with a third party.  Permission to become a reseller of our products must be obtained separately.  Placing an order on our website is not an agreement granting approval to resell our products.

Users attempting to circumvent quantity limitations, such as using multiple email addresses or accounts to exceed stated limits or placing multiple, excessive orders of the same product, may have their orders denied, and their accounts suspended from further activity.  We reserve the right to place orders into our fraud queue for review if we suspect any individuals of placing fraudulent orders or placing for the purpose of reselling our products.  This may include, by way of example, individuals (identified by credit card, email or billing address, or other attributes) placing more than three orders within 24 hours of an initial online product release. We will assess orders in our fraud queue and reserve the right to cancel multiple orders of the same items and may place any account in question on suspension.

SHIPMENT AND DELIVERY

Unless otherwise indicated at the time of ordering or by subsequent notification from us, shipments will be made via a carrier that we select, or if we give you a choice of shipping method, the carrier that you select.  If you choose an express delivery service, an additional charge will be imposed at the time of your order.  If your order is accepted and the items selected and are in stock, your order will be normally ship within the time indicated on our website.  All ship and delivery dates specified on our website are estimates only and are subject to change.  We do not guarantee delivery dates, and we are not responsible for delays by the carrier.  Risk of loss and title to ordered items pass to you upon delivery to the shipping carrier inspect your shipment upon arrival.  Report any shipping- related damage immediately to the carrier.

EXPEDITED SHIPPING CUT- OFF TIMES

* Please allow up to at least 5 business days until delivery.  Items will be shipped as soon as orders are received and processed.

* Items ordered after 12pm (ET) Monday - Thursday will be shipped on the next day.

* Items ordered after12pm (ET) Friday will ship on Monday.

ORDER PROCESSING TIME for ECONOMY SHIPPING

Please note that it may take longer to ship Economy delivery orders during peak holiday seasons, such as Mother's Day, Thanksgiving or Christmas or immediately after a popular promotion.

NATIONAL HOLIDAYS and EXPEDITED SHIPPING

We do not ship on the following U.S. national holidays:

* Memorial Day

* Labor Day

* Thanksgiving Day

* Christmas Eve

* Christmas Day 

* New Years Day

Rush orders placed during a national holiday, or during the weekend of a national holiday, will not be shipped until the following business day. 

PLEASE NOTE FREE ECONOMY SHIPPING FOR U.S. ORDERS $75 AND OVER.

PRODUCTS RESTRICTED FROM AIR SHIPPING

Certain products, such as (Concentrated) Room sprays cannot be shipped by air.  Delivery of these products are restricted to ground shipment only within the contiguous United States.  

INTERNATIONAL ORDERS

At this time, we do not ship orders internationally (outside the U.S.)

SHIPPING CHARGE DISCLAIMER

Shipping charges and terms are subject to change without notice. 

RETURNS

Returns are only accepted for items purchased on the website.  Guilty Obsessions does not accept returns of items purchased through any third party, including its retail partners.  To obtain further return information or to arrange to return your item please contact us through the Contact Us Form.  All returned items must be shipped freight pre- paid.  Please use a package delivery service able to track and / or insure your return items.  By placing an order on our website, you are accepting this return policy.  

All returns are eligible as long as they are unused and in the same condition they were received, as well as in the original packaging.  All items should be taken to a UPS, USPS, or FedEx retail location for safe and proper packaging.  Once received we will refund you the cost of the original merchandise.  However, we are unable to reimburse customers for their return shipping.

Returns should be made within 30 days of purchase.  Any returns on broken or damaged items should be returned in all original packaging.  A picture should be taken at the time of your receiving and opening of items and posted on the website via our How to Contact Us section.

SALE ITEMS

All sale items are final, and therefore, do not qualify for a return refund.

SHIPPING DISCREPANCIES

Guilty Obsessions is not responsible for shipments that have been updated to "delivered" by the carrier but not received by the customer.  This sort of issue must be resolved with the shipment company via their customer service department.

ELECTRONIC COMMUNICATIONS

When you visit our website, place an order or send e-mails to us, you are communicating with us electronically.  You consent to receive communications from us electronically.  We will communicate with you by e-mail or by posting notices on our website.  You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.  Your consent to enter into this agreement electronically covers the current transaction only.  Future transactions will require additional consent.  If you wish to have a copy of this agreement in paper form, you may print a copy from this site.

LIMITATION of LIABILITY

IN NO EVENT WILL BE LIABLE TO YOU FOR ANY INCIDENTIAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR CONNECTED WITH THIS AGREEMENT OR YOUR USE OR THE PERFORMANCE OF ANY PRODUCT, REGARDLESS OF WHETHER WE KNOW OR HAVE REASON TO KNOW OF THE POSSIBILITY OF SUCH DAMAGES, SOME STATES DO NOT ALLOW EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.  THIS PROVISION IS VOID. 

IN NO EVENT WILL OUR LIABILITY FOR ANY CLAIM OF ANY KIND, WHETHER BASED IN CONTRACT, WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, FOR ANY LOSSES OR DAMAGES ARISING OUT OF, CONNECTED WITH, OR RESULTING FROM, THIS AGREEMENT OR THE PERFORMANCE OR BREACH THEREOF, OR ANY PRODUCT OR THE USE OR PERFORMANCE THEREOF, EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.

TERMS of USE and SEVERABILITY

We provide our services to you subject to our Terms of Use, and your order and purchase are also subject to those terms which are incorporated herein.  In the event of a conflict between our Terms of Use or Privacy Policy and these Terms of Use Sale, these Terms of Sale will control.  We reserve the right to make changes to our site, policies, Terms of Use, Privacy Policy and these terms at any time.  If any part, term, or provision of these terms shall be held illegal, unenforceable or in conflict with any law of federal, state or local government having jurisdiction over these terms, the validity of the remaining portion or portions shall not be affected thereby.

CHOICE OF LAW

These terms of use shall be governed by and constructed in accordance with the laws of the state of New York and the United States of America, without giving effect to any principles of conflicts of law.  You and Guilty Obsessions irrevocably consent to the exclusive jurisdiction of the courts located in New York in connection with any action arising out of or related to these terms of use or their subject matter.  You and Guilty Obsessions waive any objection based on lack of personal jurisdiction, place of residence, improper venue or forum non convenient in any such action.

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, super any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the (Terms of Service)  Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You can review the most current version of the Terms of Service at any time on this page.  We reserve the right, at our sole discretion, to update, change or replace any part of these terms of these service by posting updates and changes to our website.  It is your responsibility to check our website periodically for changes.  Your continued use of our access to our website or the service following posting of any changes to these Terms of Service constitutes acceptance of those changes.
